The Massachusetts Supreme Judicial Court agreed that communications between a law firm’s in-house counsel and the firm’s lawyers concerning a client matter are privileged.
In a first-in-the-nation decision, the Massachusetts Supreme Judicial Court agreed that communications between a law firm’s in-house counsel and the firm’s lawyers concerning a client matter are protected by the attorney-client privilege, provided certain conditions are met.

Erin K. Higgins, and
Andrew R. Dennington are handling the case on behalf of the law firm, and successfully briefed and argued the privilege issue to the Supreme Judicial Court.
