Attorneys Kirsten Zwicker Young and Laurel Spallone received a unanimous decision from Plymouth County Retirement Board resulting in the elimination of a $96,000 demand for repayment from their client.
Their client is a retired police officer who was receiving a disability pension and the state had demanded repayment of $96,000 in pension monies that he had received for nearly a decade. Ms. Zwicker Young and Ms. Spallone argued that the state had erroneously calculated the retiree’s earnings and allowable statutory wages and the Retirement Board agreed, eliminating the demand for repayment.
