Insurance Coverage Disputes
Conn Kavanaugh has extensive experience in analyzing insurance policies and in litigating coverage claims on behalf of both insurers and insureds. We serve as national counsel for a New York insurance company, and have prosecuted and defended declaratory judgment actions for the company in several different states. As a result of our experience in this area, we also are consulted by clients about proposed changes to policy language to reflect changes in the law and the development of new types of claims.
Representative Matters:
- Obtained summary judgment for a major professional liability insurer in a declaratory judgment action filed in Massachusetts federal district court, involving a $3 million claim against an errors and omissions policy. The judgment was affirmed by the United States Court of Appeals for the First Circuit.
- Represented a surplus lines insurance company in trial and appellate litigation involving the interpretation and prioritization of “other insurance” clauses in competing liability insurance policies.
- Obtained summary judgment for insurer in US District Court case seeking coverage and defense for liability claims asserted against firearm manufacturers and dealers arising out of crimes committed with firearms.
- Obtained summary judgment for insured in a Superior Court duty to defend coverage case arising out of an underlying patent and tortious interference claims against firm's client.
