Kurt B. Fliegauf was quoted in a recent Massachusetts Lawyers Weekly article entitled, “Release does not require explicit ‘Wage Act’ cite.” The article reports that a U.S. District Court judge found that an often-cited 2012 SJC decision does not require employers to expressly include the phrase “Massachusetts Wage Act” in a release. Fliegauf said he was not surprised that the 2012 Crocker v. Townsend ruling created confusion, and that it was unclear if an employer must specifically include the Chapter 148 in an agreement. Fliegauf said, the best practice is to do so.
