The firm represents clients involved in contract disputes, including those arising out of the sale or transfer of a business or its assets, enforcement of purchase and sale agreements, franchise and distributorship disagreements, the sale of goods under the Uniform Commercial Code, and commercial collections. The firm also handles tort-based business litigation, including commercial libel and slander, interference with contracts, and fraud.
Representative Matters:
- The firm represented one of the world's largest insurance brokers in helping its insured resolve a $20 million property and casualty loss involving complex coverage and damages issues. The settlement was reported by Massachusetts Lawyers Weekly as the largest in Massachusetts in 2001.
- The firm successfully tried a jury-waived case to enforce its professional client's rights under a contract with the defendant attorney. In doing so, the firm defeated the counterclaim and convinced the Court that the defendant had falsified evidence and committed perjury. Judgment entered for the full amount of the client's damages, plus all legal and expert witness fees. The decision was affirmed on appeal.
- The firm represented a Fortune 500 company seeking more than $40 million in damages from a subcontractor. The federal court suit alleged that the subcontractor sold defective precision assembled components. The firm successfully obtained a favorable settlement.
